Electronic Records and Electronic Signatures (ERES)

From time to time, MSB Docs (“we,” “us,” or “the Company”) may be legally obligated to provide you with certain documents, disclosures, or notices in writing. This disclosure outlines how such communications will be delivered to you electronically via the MSB Docs platform.

Please read this document thoroughly. If you are able to access it electronically and agree to its terms, indicate your consent by checking the box labelled “I agree to use electronic records and signatures” and then click “AGREE” in the MSB DOCS interface.

By proceeding, you confirm that you can access and read this document in electronic format, and that you are able to retain a copy for your records, either by saving or printing it.

System Requirements

To use the MSB DOCS platform, you must meet minimum hardware and software requirements. These requirements may change over time. The current specifications are listed in our official Signing System Requirements.

How You Will Receive Notices and Disclosures

Unless you withdraw consent, we will deliver all legally required notices, disclosures, acknowledgments, authorizations, and related communications electronically through the MSB DOCS platform or via email.

To avoid missed communications, we strongly recommend you accept all notices through the same method and contact information you initially provided.

If you would prefer to receive these materials by mail instead, follow the instructions included in this document on how to withdraw your consent.

Requesting Paper Copies of This Disclosure

You may request a paper copy of this Electronic Record and Signature Disclosure or the System Requirements for Signing. To do so, email us at support@msbdocs.com and include:

  • Your full name
  • Email address
  • Mailing address
  • Telephone number

We do not provide mailed copies of documents you sign through MSB DOCS. Signed documents are available for download during or shortly after your signing session and are retained for a limited time. The specific document retention period is determined by the sending organization’s configuration and is clearly displayed within the MSB DOCS system. You are responsible for saving any signed documents you wish to keep before they are deleted.

If a mailed copy of this disclosure or the system requirements is requested, a fee per page may apply. You will be notified of any applicable charges before your request is processed.

Updating Your Contact Information

To update your email address:

To update your mailing address, use one of the following options:

  • If you have an MSB DOCS account, you can update your mailing address in your account profile
  • Email us at support@msbdocs.com and include your new mailing address

Withdrawing Your Consent

You may withdraw your consent to receive electronic communications at any point in time. Once you do, we will transition to sending required notices and disclosures in paper form only. Instructions for revoking your consent are outlined further below.

Choosing to opt out of electronic delivery may impact the speed and efficiency of completing transactions with us. Paper-based communications are inherently slower and may delay certain processes. Additionally, you will no longer be able to:

  • Use the MSB DOCS platform to sign documents electronically
  • Complete transactions digitally in real time within the MSB Docs Application

Withdrawal of consent will apply only to future transactions and communications. It will not affect the validity or enforceability of documents previously signed or delivered electronically, nor will it halt any transactions already in progress.

If we are legally required to continue providing certain notices or disclosures in writing, and you have withdrawn electronic consent, those communications will be delivered to you in paper format, typically by regular mail, using the most recent mailing address you provided. This may result in processing delays. This applies to required legal or regulatory notices only, not to previously signed documents or completed transactions. You are responsible for downloading or saving any documents you wish to retain while they are available in the MSB DOCS platform.

To withdraw consent:

  • Send an email to support@msbdocs.com including your full name, email address, mailing address, and phone number.

Limitation of Consent

Your agreement to use electronic records and signatures will only apply to transactions and communications occurring after you provide consent. This agreement does not apply retroactively to documents or communications sent prior to your acceptance.

Your Acknowledgment and Consent

By checking the box labelled “I agree to use electronic records and signatures”, you confirm that:

  • You have read and understood this Electronic Record and Signature Disclosure
  • You are able to view, save, or print this document
  • You consent to receive all required communications electronically from MSB Docs unless and until you notify us otherwise
